ノーラさあ・・・

リン人殺したんだから、証言台で泣かなきゃ。泣きのテクニックとかなにかないわけ？　なに見てんのよ？

リンこの写真の人、ビリーっていって、先週脳腫瘍で死んじゃったの、ああ悲しい！　泣きたくなってきた？　なに？

シーン7　◆法廷。ホルト（被害者の愛人）への証人尋問
検事被害者とはどういう関係でしたか、ホルトさん？
What was your relationship with the victim, Ms. Holt?
ホルト彼の理学療法士でした。血行障害で脚を失った彼に、義足を使うリハビリ訓練をしていました。
I was his physical therapist. He'd lost a leg due to his blood circulation problem, and I was helping him gain use of his prosthesis.
検事あー、それで、その訓練の最中に？
Uh, and during this therapy ...?
ホルトそう。おたがいに・・・相手の肉体にすっかりおぼれてしまって。
Well, we fell in ... physical infatuation with one another.
検事ホルトさん、お話しいただけますか、昨年の12月14日の夜のことを。
Ms. Holt, calling your attention to the evening of December 14th of last year.
ホルトはい。私たちは彼の家で愛し合っていました。
Yes. We were at his home, making love.
検事それから？
And what happened?
ホルトその、真っ最中に彼女が入ってきた。

ホルト人殺し。
The murderer.

判事認めます。その人はこの部屋にいますか？

ホルトええ、いますとも！　あの人殺し。

判事証人は被告人を示しました。「人殺し」という単語は削除。
The witness has identified the defendant. The term "murderer" is stricken.
検事ホルトさん、その後どうなりました？　被告人が入ってきてから。
Ms. Holt, what happened after the ... defendant entered the room?
ホルト彼女は彼の義足を手に取ると、彼の頭を激しくぶち始めたんです。
She grabbed his graphite leg and began to thump him wildly on the head.
検事それから？
And then?
ホルト彼はベッドから出て逃げようとしましたが、義足がないので至難の技。逃走の足そのものにぶちのめされるなんて！　それから、彼は右手で彼女を突き飛ばし、血を流しながら必死で玄関にはねていき、彼女はそれを追いながら、義足でずっとぶち続けました。そして、つまづかせたんです。彼はごろごろ階段を落ちて、こと切れた。彼女は凶器を落として・・・すみません、ぶってた道具を落として、走り去った。彼の脚は最後までぴくつき、もう1本は証拠品に。
He jumped out of bed and attempted to flee, which was made very difficult, she having his leg. He was being thrashed by the very thing he needed for escape. Then, he pushed her off with his right arm. By this time, he was bleeding, hopping madly down the hall, she giving chase all the while, thumping him with his own prosthetic. Then, she tripped him. He went crashing down the stairs, and that was the end of him. Then, she just dropped the murder weapon and ... excuse me, the thumping device, and ran off. He just lay there, one leg twitching, the other evidence.
　
＜かめっより＞　証人ホルトさんはイギリス式発音。慣れてないとかなり聞き取りにくいと思います。今回は依頼人のノーラと検事、歌のグロリア・ゲイナーもけっこう黒人英語を強調した話し方です。

シーン8　◆ホルトへの反対尋問（ｂｙアリー）
アリー激しくぶった、とおっしゃいましたが。彼女の反応はそれほど激しいものだった、そういうことですね？
You said "swinging wildly." So, you would say that she had a wild reaction, would you say that?
ホルト「微妙」とは言えないわよね。
Well, it certainly wasn't subtle.
アリーあー・・・その時の夫人のふるまいをどう表現なさいます、一般人として？
Hmm. ... As a lay person, how would you describe Mrs. Mills' behavior?
ホルトそうね、ズバリ、殺人的。
I'd describe it as murderous.
アリーんん・・・。彼女はとても動揺していた？
She was very upset?
ホルトかなり。

アリー私の反対尋問のあとで、なんでまた質問したりしたの？

マーク気づいてたんだ？

アリー「気づいてたんだ」？　陪審員の前で、人コケにしといて！
I noticed it? You undermined me in front of the jury.
マークそんなんじゃない。
No, I didn't.
アリーどうしてわざわざあんな質問なさったのか、教えてくれる？
Can you tell me why you stood up to ask a little question?
マークああ、それは言質を取るためさ、ショック状態にあった、って。ショックを受けると人は観察力や判断力が鈍る。彼女は検察側の唯一の証人だから、信用性に揺さぶりをかけられたらなって。
Yeah, sure. I wanted to get in that the witness was in shock a little. Shock compromises the capacity to observe and comprehend. And, since she is the lead and only prosecutorial witness, I thought it might be nice to show that maybe she was wrong.

What do you mean, how's he doing? He's dead, for god's sake.
リチャード聞いたのはマークのこと。

アリーああ・・・。雇った理由、まだ見えない。
Oh. ... I still don't know why you hired him.
リチャードウチに必要だからだろ。
I hired him because we need him.
アリー必要ない。
We don't need him.
リチャード前に進んでくしかない、アリー。それが事務所のため。経営者として言ってるの。仕事は待ってくれないんだ。そこんとこ、よろしく。いい？

ノーラ寝室に入ったんです、この私の寝室に。そしたら主人がベッドでほかの女と愛し合ってた。
I walked into my bedroom, my very own bedroom. And I saw my husband making love to another woman.
リンそれを見てどんな思いを？
What went through your mind when you saw this?
ノーラあー・・・自分の中にあった善悪の判断がすっかり吹っ飛びました。
Uh ... I lost all ability to distinguish right from wrong.
判事なんですって？
Excuse me?
ノーラ顔がカーッとなって、脚がなえそうでした。
My face felt hot, my legs felt weak.
リンだから、代わりをつかんだ？

ノーラなんの話？　・・・　ああ、そうです！　ベッドのすぐ足下の床に主人の義足が転がってるのを見て、拾い上げました。
Excuse me? ... Oh, yes! I saw my husband's graphite leg on the floor lying next to the bed, and I picked it up.

＜注＞　manslaughter: 通常、「故殺」と訳されます。リンの言う「過失致死」は、分かりやすく日本の法制に当てはめた訳語（ナイス！）。

日本の刑法では文字どおり人を殺す意思があった場合だけを「殺人」罪と呼び、それ以外は「過失致死」または「傷害致死」として殺人の範ちゅうに入れていません（殺意の有無により区別）。アメリカ法はもっと複雑な区分けです。が、おおまかにいうと、ノーラが当初起訴されていた「murder(謀殺)」は日本法の「殺人」に該当し、それより軽い「manslaughter(故殺)」は日本の「過失致死」に該当すると言えます。以下、アメリカの用語を整理してみますね（Thanks! ＞ れいこさん　＆ 有斐閣「英米法辞典」参照しました）。

　　・first-degree murder：第一級謀殺。予謀（毒殺など）のある殺人。ほかの重罪を伴う殺人。
　　・second-degree murder：第二級謀殺。上記以外。
　　※ 日常会話では murder は、一般的に「人殺し」を指す言葉としてアイマイに使われます。
　●manslaughter：故殺。殺意のない殺人。
　　　　軽度の傷害や暴行を加える意思をもって実際には人を殺した場合と、その意思もなく人を
　　　　殺した場合。（日本の傷害致死の一部、過失致死の大部分に相当する）。
　●homicide：殺人。murder, manslaughter の両方を含む表現。
